The trio is investigating claims that Gensler may have engaged in politically biased hiring practices at the agency, potentially violating the Civil Service Reform Act of 1978. The Committees on the Judiciary, Financial Services, and Oversight and Accountability spearhead this probe, focusing on whether political affiliations have unduly influenced the hiring of SEC employees.

The investigation was prompted by allegations that the agency may have employed civil service staff based on political leanings rather than merit. A letter from the Committees to Gensler requests extensive documentation to determine if there is any validity to these claims.

Central to the inquiry is the decision to hire Dr. Haoxiang Zhu as the Director of Trading and Markets. Email communications disclosed during SEC rulemaking discussions revealed that Dr. Zhu had explicitly referenced his ideological alignment in an email to Gensler before his hiring.

This email, sent on May 18, 2021, suggested that Zhu believed his political views were compatible with the agency’s leadership and offered further details to reassure Gensler of his suitability. Despite this, Dr. Zhu was officially hired on November 19, 2021.

Implications for SEC’s Impartiality

The Committees are concerned that if these allegations hold true, the agency’s hiring practices may be unlawfully skewed toward individuals with specific political ideologies. Such actions would compromise the SEC’s ability to function impartially and uphold its regulatory responsibilities.

To investigate these concerns, the Committees have requested documentation dating back to April 17, 2021, including all records related to hiring, employment, termination, or transfer of key positions and any communications about job applicants’ political affiliations.

Gensler has been given a deadline of September 24, 2024, to provide the requested information. The Committee on the Judiciary oversees matters concerning civil liberties, the Committee on Financial Services monitors the SEC, and the Committee on Oversight and Accountability is tasked with overseeing the federal civil service.

However, the Committees’ oversight is expected to shed light on whether the agency’s hiring processes have been compromised and whether legislative reforms might be necessary to reinforce the independence and neutrality of the SEC. The inquiry remains ongoing, with further developments anticipated as more details emerge.
